Complex personal injury

Medical device and product liability
  • Defective Hip Implants: Taschner has been significantly involved in nationwide litigation concerning the global recall of thousands of defective hip devices by multiple manufacturers. DePuy paid over $4 billion to settle ASR hip lawsuits, and over $1 billion to settle Pinnacle hip lawsuits.  Individual settlement amounts varied based on severity of the injury and other factors.
  • Transvaginal Mesh: Taschner served as counsel in significant litigation against manufacturers of vaginal mesh devices, which included a $119 million settlement against Boston Scientific involving nearly 3,000 cases.
  • Pharmaceutical Litigation: Taschner has pursued claims related to numerous pharmaceutical drugs, including the $3.75 billion diet drug Fen-Phen, the diabetes drug Rezulin, $800 million Zyprexa settlement, and the blood thinner Xarelto.  He was involved in the $4.85 billion settlement with the pharmaceutical company Merck over its drug Vioxx.

Kikuchi determining application of federal rules for international service of legal process under the Hague Service Convention. The case decision was published in Federal Rules Digest, has been cited by numerous courts in determining international service of process abroad, and is noted in the Harvard Journal of Law & Technology article "CATCH ME IF YOU CAN: SERVING UNITED STATES PROCESS ON AN ELUSIVE DEFENDANT ABROAD." 
Constitutional and civil rights claims
  • Civil Rights and Class Actions: Taschner has brought individual and class-action claims under the U.S. Constitution and civil rights acts. These claims have addressed issues such as underenforcement of domestic violence laws, racial profiling, and failures to provide adequate medical care in detention facilities.

A Landmark Case on Domestic Violence 

The Case: Taschner represented the family of a young woman who was brutally murdered by her ex-husband who was employed by the Los Angeles Police Department despite her repeatedly seeking help from the LAPD. Taschner filed a civil rights claim against government agencies, alleging that their deliberate indifference and failure to protect the victim amounted to a violation of her civil rights. 

The Outcome: Taschner's efforts secured a substantial settlement for the family, but the case's impact extended beyond compensation.  It drew national scrutiny to the systemic failings in how law enforcement handled domestic violence cases.

National Attention and Legal Reform: The publicity and outcome of the case helped shed light on a pattern of neglect and helped spur legislative changes aimed at holding law enforcement accountable for failing to enforce domestic violence protection orders. 

Impact: Former California Governor Gray Davis recognized Taschner's work with a "Lawyer of the Year" Award for providing "the voice of justice in protecting the basic human rights of your clients."   The Domestic Violence Offender Gun Ban, often called the "Lautenberg Amendment" ("Gun Ban for Individuals Convicted of a Misdemeanor Crime of Domestic Violence", was enacted by the 104th United States Congress, and bans access to firearms for life by people convicted of crimes of domestic violence.  The act was proposed following the landmark decision of the United States Court of Appeals for the Ninth Circuit in the lawsuit brought by Taschner under the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. President Bill Clinton signed the law as part of the Omnibus Appropriations Act of 1997
